Refusing these tests after being placed under arrest can trigger an automatic administrative license suspension under the state’s implied consent laws. This suspension is separate from any criminal penalties and can be enforced even if the DUI charge doesn’t lead to a conviction. A DUI arrest in Virginia is typically issued when a driver is suspected of operating a vehicle with a blood alcohol content (BAC) of 0.08% or higher. A charge can result from evidence of impairment due to drugs, whether prescription, over-the-counter, or illegal substances. For commercial drivers, the legal limit is 0.04%, and for individuals under 21, Virginia enforces a zero-tolerance policy with a 0.02% BAC threshold.

What Happens Immediately After an Arrest

Once you’re taken into custody for DUI, you will be processed at the local jail or police station. Depending on factors like your BAC level, prior offenses, or whether a crash occurred, you may be released on your own recognizance or required to post bail.

In many first-time cases, there’s a mandatory license suspension and a possibility of being ordered to install an ignition interlock device if you request restricted driving privileges. More severe or repeat offenses may carry mandatory jail time, higher fines, and extended loss of driving privileges.
