A Study of State Judicial Discipline Sanctions

A Study of State Judicial Discipline Sanctions begins with a brief overview of the state judicial discipline systems, supplemented by tables that identify the sanctions available in each state. All cases (approximately 110) from 1990 through 2001 in which judges have been removed from office as a result of judicial discipline proceedings are examined, categorized by the type of misconduct at issue. The Study then analyzes the cases in which there has been disagreement about the appropriate sanction, either between the commission and the state supreme court or among the members of the supreme court as reflected in dissents. The Study also catalogs the factors supreme courts and conduct commissions have listed as relevant in determining the appropriate sanction and analyzes the cases to discuss issues such as the importance of the judge’s reputation in the sanction decision and the role remorse plays. Finally, the Study makes recommendations for states to consider in pursuing the goal of fair, effective judicial discipline.
An Ethics Guide for Judges and Their Families

Ethical Issues for New Judges

Faced with the prospect and privilege of doing justice and administering the law, a new judge must make changes in community activities, political conduct, and financial practices to comply with a new responsibility to “act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.” Moreover, a new judge must make a professional shift from advocate to impartial arbiter.
This paper outlines the advice judicial ethics committees have given to new judges to guide them in making that transition. It lists the inquiries a newly chosen judge should make about charitable, political, and business activities to evaluate what changes are necessary to conform to the judicial ethics rules. It considers whether a new judge may accept gifts, including receptions, that are offered to mark the new position.
The paper also discusses winding-up a law practice, including completing pending cases, duties to clients, disposing of an interest in a law firm, receiving fees for work completed before taking the bench, and disassociation from a law firm. Finally, the paper examines the disqualification issues frequently faced by a new judge.
