Judicial Disqualification One Year after
Caperton v. A.T. Massey Coal
On June 8, 2009, the
U.S. Supreme Court held that due process required the disqualification of a
state supreme court justice based on extraordinary expenditures in support of
his candidacy by a principal for a party in a case pending before the court at
the time of the campaign. Caperton v. A. T. Massey Coal Co., 129 S. Ct.
2252 (2009). The decision was hailed as a crucial first step in judicial
disqualification reform -- and criticized as inviting limitless challenges to
judicial impartiality. This program will examine the decision and developments
in the year since to evaluate what, if anything, changed after Caperton.
