Ethical Implications of Political
Activities by Members of a Judge’s Family
Consistent with the
right to free speech contained in the First Amendment, the code of judicial
conduct does not prohibit members of a judge’s family from engaging in political
activity. However, judges must ensure that family members are careful that
their involvement in political activity is and appears to be independent from
the judge and conducted without reference to the judge or the judge’s office.
This program will address what steps judicial families should take when family
members are candidates for public office, supporters of candidates, or otherwise
involved in party politics to avoid inappropriately entangling the judiciary in
politics.
